Terms and Conditions
Hughes Group Trading as Pink Pixel
These Terms and Conditions govern all services provided by Hughes Group t/a Pink Pixel (“Pink Pixel”, “we”, “us”, or “our”) to any client (“Client”, “you”, or “your”) in accordance with the laws of the Republic of South Africa.
By accepting a quotation, paying a deposit, or engaging our services, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
1. SERVICES
Pink Pixel provides professional services including but not limited to:
• Graphic Design
• Website Design and Development
• Printing Services
• Signage Production and Installation
• Branding and Marketing Materials
• Digital Content and Online Services
All services are provided in accordance with the project scope agreed upon in the quotation.
2. QUOTATIONS
2.1 All quotations issued by Pink Pixel are valid for 7 (seven) days unless otherwise stated.
2.2 Quotations are based on the specifications provided by the Client at the time of quoting.
2.3 Any changes to the project scope may result in additional costs.
2.4 Pink Pixel reserves the right to revise quotations if the project requirements change.
3. DEPOSITS AND PAYMENTS
3.1 A minimum deposit of 50% is required before work will commence.
3.2 The remaining balance must be paid before final delivery, printing, installation, or website launch.
3.3 Deposits are non-refundable once work has commenced.
3.4 Pink Pixel reserves the right to suspend services for non-payment.
3.5 Interest may be charged on overdue accounts at 10% per month or the maximum rate permitted by South African law.
4. CLIENT RESPONSIBILITIES
4.1 The Client must provide all required content including:
• Text
• Logos
• Images
• Branding guidelines
• Product information
4.2 The Client warrants that they own the rights to all content provided.
4.3 Pink Pixel shall not be held liable for copyright infringement resulting from materials supplied by the Client.
5. DESIGN AND APPROVAL
5.1 Clients will receive design proofs for approval before production.
5.2 It is the Client’s responsibility to carefully check spelling, layout, colours, and information before approving designs.
5.3 Once final approval is provided, Pink Pixel shall not be responsible for errors identified afterwards.
5.4 Additional revisions beyond the agreed number may be charged at the applicable hourly rate.
6. PRINTING SERVICES
6.1 Colours displayed on screens may differ from printed colours due to variations in monitors, inks, and printing processes.
6.2 Pink Pixel will make every reasonable effort to match colours but cannot guarantee exact colour reproduction.
6.3 Minor variations in colour, alignment, trimming, or material are considered acceptable within industry standards.
6.4 Pink Pixel shall not be responsible for defects caused by incorrect artwork supplied by the Client.
6.5 Printed products cannot be returned unless they are proven to be defective due to a production error by Pink Pixel.
7. SIGNAGE SERVICES
7.1 Signage installation dates may be affected by factors outside Pink Pixel’s control including:
• Weather conditions
• Site access restrictions
• Municipal approvals
• Power outages
7.2 The Client must ensure that all necessary permissions and approvals have been obtained prior to installation.
7.3 Pink Pixel shall not be liable for damages caused by:
• Structural issues
• Third-party interference
• Environmental conditions
8. WEBSITE DESIGN AND DIGITAL SERVICES
8.1 Website projects will commence once the required deposit has been received.
8.2 The Client must supply all website content within 7 (seven) working days of project commencement unless otherwise agreed.
8.3 Delays in providing content may delay project completion.
8.4 Pink Pixel does not guarantee specific search engine rankings or SEO results.
8.5 The website will only be made live once full payment has been received.
9. WEBSITE HOSTING AND DOMAINS (IF APPLICABLE)
9.1 Hosting and domain services may be billed monthly or annually.
9.2 Failure to pay hosting or domain fees may result in website suspension.
9.3 Pink Pixel shall not be responsible for any loss of data resulting from:
• Server failures
• Third-party hosting issues
• Cyber attacks or hacking
10. INTELLECTUAL PROPERTY
10.1 All designs, artwork, and digital work created by Pink Pixel remain the intellectual property of Pink Pixel until full payment has been received.
10.2 Upon full payment, the Client receives the right to use the final approved design for its intended purpose.
10.3 Pink Pixel reserves the right to display completed work in portfolios and marketing materials.
11. LIMITATION OF LIABILITY
Pink Pixel shall not be liable for any direct, indirect, incidental, or consequential damages including but not limited to:
• Loss of profits
• Loss of business
• Loss of data
• Delays caused by third parties
12. FORCE MAJEURE
Pink Pixel shall not be liable for delays or failure to perform obligations due to events beyond its reasonable control including but not limited to:
• Natural disasters
• Power outages
• Internet failures
• Government restrictions
• Strikes or labour disputes
13. CANCELLATION
13.1 If a project is cancelled after work has commenced, the Client shall be liable for all work completed up to the cancellation date.
13.2 Deposits remain non-refundable.
14. GOVERNING LAW
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any disputes arising from services provided by Pink Pixel shall be subject to the jurisdiction of the South African courts.
15. ACCEPTANCE OF TERMS
By accepting a quotation, making payment, or engaging the services of Pink Pixel, the Client confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
